Terms of Service

By connecting to the Imperium Minecraft server, creating an account on this website, or otherwise using any Imperium MC service ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service or purchase anything from our store. These terms apply in addition to the Minecraft EULA, Mojang Studios brand guidelines, and the End User License Agreement for our store.

All purchases in the Imperium store, including supporter tiers, cosmetics, crate keys, and any other digital items, are final and non-refundable. Because these are digital goods delivered and usable instantly upon purchase, we do not offer refunds, credits, or exchanges except where a refund is required by applicable non-waivable consumer-protection law. Filing a payment chargeback or dispute without first contacting us will be treated as a violation of these Terms and will result in termination of your account. We are not obligated to keep the server online or available at any time. The Service is provided on a best-effort basis, and we make no guarantee that it will be uninterrupted, error-free, secure, or accessible. The server may go down for maintenance, technical failure, hosting issues, or any other reason, with or without notice. If the server is offline, slow, or unavailable for any period, you are not entitled to any compensation, refund, credit, or extension of your perks.

Where any perk, tier, or item is described as "Lifetime" or "permanent", that means it lasts for as long as the Imperium MC server is operational, nothing more. If the server shuts down, is sold, is transferred to new ownership, or otherwise ceases to operate, all Lifetime and permanent perks end with it. You are NOT entitled to a refund, credit, compensation, or any continuation of perks if the server shuts down or changes hands. We will try our best to keep the server running, but we cannot guarantee indefinite operation.

We reserve the right to add, modify, rebalance, rework, or remove any perk, item, feature, or benefit at any time, with or without notice. This includes perks that were paid for. We will try our best not to remove or significantly weaken perks that players have paid for, but we reserve the right to do so if necessary for game balance, technical reasons, legal compliance, or the continued health of the server. Game balance, leaderboards, reward values, and perk effects may change as the realm evolves, and no perk is guaranteed to remain unchanged forever.

Aureus, Denarius, Auctoritas, Civitas, and every other in-game currency, token, or point are virtual currency with no real-world monetary value. They cannot be exchanged for real money, refunded for cash, or transferred outside the Service. They represent a limited license to use features within Imperium MC only and may not be sold, traded, or bartered for real-world goods, services, or money outside the game. We may adjust currency balances, earning rates, or sinks at any time.

You are responsible for maintaining the confidentiality of any credentials used to access the Service and for every action taken under your account. Imperium MC links your Discord ID and Minecraft UUID to your profile; keep both accounts secure. You must be of sufficient age to form a binding contract in your jurisdiction, and you are responsible for all activity and all purchases made under your identities, including unauthorized purchases made through a compromised account. Notify us immediately on Discord if you believe your account has been compromised.

You agree not to cheat, exploit bugs, use unauthorized client modifications, automate gameplay, harass other players, transmit malware, evade moderation, impersonate staff, or otherwise disrupt the Service. Imperium is a community-first server; toxic, hateful, or unlawful conduct is not tolerated. Detailed rules are posted in our Discord and may be updated as the community grows.

The Imperium MC team reserves the right to warn, mute, kick, temporarily suspend, permanently ban, or otherwise terminate access to the Service for any player, at any time, for any reason, including (but not limited to) violations of these Terms, the in-game rules, or the Mojang EULA. Enforcement decisions are made at the discretion of our staff and are final. If your account is terminated, you may lose access to all purchased items with no refund. Bans may be appealed through the ticket system in our Discord, but are not guaranteed to be overturned.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will meet your requirements, that it will be uninterrupted or error-free, or that defects will be corrected. You use the Service entirely at your own risk.

To the fullest extent permitted by law, Imperium MC and its operators, staff, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of (or inability to use) the Service. This includes any loss of in-game progress, currency, cosmetics, account access, data, or goodwill, and any amount spent on purchases. Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the three (3) months preceding the claim. Payments are processed by PayNow Services, Inc. as merchant of record. Chargeback disputes, payment disputes, and refund requests are handled by PayNow under the PayNow Buyer Agreement and applicable payment network rules (Visa, Mastercard, American Express, Discover, PayPal, and all other supported payment methods). We are not the merchant of record for any transaction and do not control payment dispute resolution.

IMPORTANT: BY USING THIS SERVICE, YOU AGREE THAT ANY DISPUTE WILL BE RESOLVED THROUGH BINDING INDIVIDUAL ARBITRATION, NOT IN COURT. You and Imperium MC waive any right to participate in a class action lawsuit or class-wide arbitration. Arbitration is administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitrator, not a judge or jury, will resolve the dispute. You may opt out of arbitration within 30 days of creating your account by emailing privacy@imperiummc.net with the subject "Arbitration Opt-Out." If you do not opt out, arbitration replaces your right to go to court. This arbitration provision survives termination of these Terms. (This provision is made pursuant to the Federal Arbitration Act, 9 U.S.C. §§ 1-16.)

You agree to indemnify, defend, and hold harmless Imperium MC, its operators, staff, volunteers, and affiliates from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your violation of these Terms or the in-game rules; (b) your violation of any law or third-party rights; (c) your use of the Service; (d) any chargeback or payment dispute you initiate in violation of these Terms; or (e) any fraudulent or abusive activity on your account. We reserve the right to assume the exclusive defense of any claim subject to indemnification, and you agree to cooperate with us in asserting any available defenses.

Filing a chargeback or payment dispute with your bank, card issuer, PayPal, or any payment provider for a purchase you authorized, without first contacting us on Discord to resolve the issue, is a material breach of these Terms. All payment disputes are handled by PayNow Services, Inc. as the merchant of record, under PayNow's dispute resolution process and the rules of the applicable payment network. Unauthorized chargebacks will result in immediate and permanent account termination, loss of all purchased items without refund, and where applicable, collection action to recover the chargeback amount, associated fees, and costs. If you have a genuine billing issue, contact us on Discord first and we will work with PayNow to resolve it.

Imperium MC is an unofficial, third-party Minecraft server. Minecraft is owned by Mojang Studios and Microsoft Corporation. We are not affiliated with, endorsed by, sponsored by, or connected to Mojang Studios, Microsoft Corporation, or any of their related entities. "Minecraft" is a trademark of Mojang AB. All references to Minecraft, Mojang, or Microsoft are for descriptive purposes only. We operate under Mojang's Commercial Usage Guidelines; see our EULA page for details.

We may update these Terms at any time. Material changes will be announced in our Discord, and the "last updated" date below will reflect the revision. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms. It is your responsibility to review these Terms periodically.

You must be at least 18 years of age (or the age of legal majority in your jurisdiction, whichever is higher) to use this website or purchase anything from our store. By using the Service and completing a purchase, you represent and warrant that you are 18 or older and have the legal capacity to enter into a binding agreement. If we discover that you are under 18, your account may be terminated and all purchases voided without refund. This age requirement exists because our payment processor, PayNow, requires all users to be adults, and because purchases constitute legally binding contracts. This Service is not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us personal information, contact us immediately and we will delete it. (COPPA, 15 U.S.C. §§ 6501–6506.)

All payments on this website are processed by PayNow Services, Inc., which acts as the merchant of record and our commercial agent for payment processing. PayNow handles payment authorization, tax calculation and remittance, chargeback disputes, and refund reviews. When you make a purchase, you also agree to the PayNow Terms of Use, the PayNow Buyer Agreement, and the PayNow Platform End User License Agreement, all of which are linked on our PayNow Compliance page. PayNow’s arbitration, limitation of liability, and governing law (Pennsylvania) provisions apply to every transaction.

PayNow supports 120+ payment methods globally, including credit and debit cards (Visa, Mastercard, American Express, Discover, JCB, UnionPay), digital wallets (Apple Pay, Google Pay, PayPal, Cash App Pay, Venmo, Samsung Pay, Amazon Pay), buy-now-pay-later services (Klarna, Afterpay, Zip), bank transfers (SEPA, iDEAL, BLIK, Bancontact, UPI, Pix, Pay by Bank), prepaid vouchers (OXXO), cryptocurrency, Steam Skins, and numerous regional and local payment methods. The specific methods available to you depend on your country and are presented at the PayNow checkout page. We do not store, process, or transmit any payment card data — all payment information is handled directly by PayNow and its payment processors under PCI-DSS compliance. We never see your card number, bank account, or wallet credentials. By using this store, you agree to PayNow’s processing of your payment through any of these methods, subject to the terms of your card issuer, bank, or wallet provider (including but not limited to Visa, Mastercard, Amex, Discover, JCB, UnionPay, PayPal, Klarna, Cash App, Apple Pay, Google Pay, and any other provider’s applicable terms).

Monthly subscriptions automatically renew each billing cycle until you cancel. By subscribing, you authorize PayNow to charge your payment method on a recurring monthly basis until cancellation. You may cancel at any time from your dashboard at imperiummc.net/dashboard/subscription, cancellation stops future charges but does not refund the current billing period. You will continue to receive subscriber benefits until the end of the period you have already paid for. If your payment method fails, PayNow may retry the charge; if it cannot be processed, your subscription will be deactivated after a grace period. Pricing is displayed in USD; taxes are calculated and added by PayNow based on your jurisdiction. To cancel, avoid future charges, or update your payment method, visit your dashboard or contact us on Discord before your next billing date. (Cal. Bus. & Prof. Code § 17600 et seq.; similar auto-renewal laws apply in other U.S. states and jurisdictions.)

All items sold are digital goods delivered electronically. Lifetime purchases grant a perpetual license to use the item for the lifetime of the Imperium MC server, not your lifetime or any fixed term. One-time (lifetime) purchases are a single non-recurring charge with no automatic renewal. Subscriptions are recurring charges that renew until cancelled. In-game currencies (Denarius, Aureus, Auctoritas, Civitas) have no real-world monetary value and cannot be exchanged for real money, refunded for cash, or transferred outside the game. Cosmetics, trails, and visual effects are non-transferable between accounts. All items are licensed, not sold, you receive a limited, non-exclusive, non-transferable, revocable license to use them within Imperium MC.

By using this store, you represent that you are not located in a country subject to a U.S. government embargo or trade restriction, and that you are not on any restricted-party list maintained by the U.S. government (including the Specially Designated Nationals List). You agree to comply with all applicable export and import laws. (50 U.S.C. § 1701 et seq.; 15 C.F.R. Parts 730-774.)

If you have any issue with a purchase, a charge, a bug, or any dispute, you agree to contact us first through our Discord ticket system and give us a reasonable opportunity to resolve it before filing a chargeback, contacting PayNow, filing a complaint with a government agency, or initiating legal proceedings. We are committed to working with you to find a fair resolution. Contacting PayNow or your payment provider without first giving us a chance to help may slow down the resolution process. We welcome responsible bug reports from our community. If you find a bug, exploit, or security issue, report it through our Discord ticket system. Our staff reviews each report. If we determine a bug is significant, staff and management may award an Aureus (in-game currency) bounty at their sole discretion. The amount varies based on severity and impact. This is entirely discretionary and not guaranteed. Reporting a bug does not entitle you to any reward. Response times to bug reports are averages and not guaranteed. We appreciate all reports that help make Imperium MC better for everyone.
